Judge David Unterhalter has finally gained approval by the Judicial Service Commission (JSC) for promotion to the Supreme Court of Appeal (SCA), on his fifth bid for a higher position.

Unterhalter is one of three judges put forward by the JSC as their chosen candidates for vacancies on the SCA. The other two are Gauteng High Court Judge Raylene Keightley and Eastern Cape High Court Judge John Smith.

News24 reports that the JSC interviewed 10 candidates for four vacancies at the SCA in October.

At the time, the JSC chose not to fill two of the vacancies and snubbed several potential candidates, including the renowned Unterhalter.

Freedom Under Law said Unterhalter was unfairly disqualified on the basis of unsubstantiated claims of racism and arrogance.
